Ambassador Eliasson sets out the current status of Europe-US relations and acknowledges the wide range of daunting problems the world must face today. He emphasizes the need for an enhancement of the transatlantic relationship, as well as the need for multilateral cooperation. Mr. Eliasson also reinforces the importance of a continued awarenesss of the economy, the environment, and ethics.

Synopsis

Although unsure whether there will in fact be a new transatlantic agenda, Ambassador Eliasson repeatedly highlights that it is crucial that it does happen if we are to challenge the ‘huge’ issues of today. Mr. Eliasson notes the current financial climate and its possible effects on the social and political spheres as worrying. He also expresses particular concern at what he calls ‘fortress building,’ which involves protectionism and intolerance. Mr. Eliasson goes on to explain that as it stands, current US-Europe relations are dominated by mutual interest on security and the economy. However, to Mr. Eliasson, this relationship is marred by several issues. Inside the EU, democracy is in a predicament with politicians being accountable nationally while the issues are international. Moreover, Mr. Eliasson feels that the nature of the US and Europe relationship is not representative of the responsibility it should carry by being the most prosperous regions of the world.

How is this transatlantic relationship to move forward? If we are to arrive at what Mr. Eliasson describes as ‘scenario 1,’ which involves long term thinking, regulation, an emphasis on ethics, and a realization of interdependence in an internationally cooperative system, then Mr. Eliasson argues this requires reform. Mr. Eliasson argues it is urgent not to separate politics and economics. In dealing with a financial crisis, we must employ a multilateral approach and learn lessons for the future, particularly not fearing international regulation in a globalized economy. Mr. Eliasson also explains we can avoid this protectionist ‘fortress building’ by embracing ‘multipolarity.’ Mr. Eliasson underscores the importance of tolerance and good governance as central to progress. In addition, Mr. Eliasson reinforces that the problems of today are on such a massive scale that they must be dealt with internationally, as well as regionally and in the private sector.

Dealing with such issues, which involve collective engagement in Afghanistan and a cooperative approach in Africa, is what Mr. Eliasson believes must be added as a ‘third pillar’ to the US and Europe’s relationship. Mr. Eliasson also stresses concrete action on poverty by the US and Europe as central to this effort. In particular, he places emphasis a program for education of women and the establishment of clean water access. Mr. Eliasson believes that such efforts, which would add a pivotal ethical dimension to the transatlantic agenda, would enhance the reputation of democracy across the globe through concrete action.

In engaging with the audience in a question-and-answer session, one of the most emphasized subjects was diplomatic standards for international relations. Mr. Eliasson strongly reinforced the notion that the transatlantic agenda should stand with clear ethical standards. Other issues addressed included Iran's nuclear capabilities, religion, and the role of Russia.

About the Speaker

Ambassador Jan Eliasson was until July 1, 2008 Special Envoy of the United Nations Secretary-General for Darfur. Previously, Jan Eliasson was President of the 60th session of the United Nations General Assembly 2005-2006. He was Sweden’s Ambassador to the United States, 2000-2005. Mr. Eliasson was Minister for Foreign Affairs of Sweden in 2006.

Mr. Eliasson served from 1994 to 2000 as State Secretary for Foreign Affairs, a key position in formulating and implementing Swedish foreign policy. Earlier, 1988-1992, he was Sweden’s Ambassador to the United Nations in New York. During this period, he also served as the Secretary-General’s Personal Representative for Iran/Iraq.

In 1992, Mr. Eliasson was appointed the first United Nations Under-Secretary-General for Humanitarian Affairs and was involved in operations in Somalia, Sudan, Mozambique and the Balkans. He also took initiatives on landmines, conflict prevention and humanitarian action.

1980-1986, Mr. Eliasson was part of the UN mediation missions in the war between Iran and Iraq, headed by former Prime Minister Olof Palme. In 1993-94 Mr. Eliasson served as mediator in the Nagorno Karabakh conflict for the Organization for Security and Co-operation in Europe (OSCE). He has been Visiting Professor at Uppsala University and Göteborg University in Sweden, lecturing on mediation, conflict resolution and UN reform.

During his diplomatic career, Mr. Eliasson has been posted to New York (twice) Paris, Bonn, Washington (twice) and Harare, where he opened the first Swedish Embassy in 1980. He served as Diplomatic Adviser to the Swedish Prime Minister 1982-1983, and as Director General for Political Affairs in the Swedish Ministry for Foreign Affairs 1983-1987.

Mr. Eliasson has authored and co-authored numerous articles and books and is a frequent lecturer on foreign policy and diplomacy. He is recipient of honorary doctorate degrees from i. a. American University, Washington, D.C., Uppsala University and Göteborg University, Sweden. He has been decorated by a number of Governments.

He is the Chairman of the Anna Lindh Memorial Fund of Sweden and is Member of the Advisory Group to the International Committee of the Red Cross (ICRC), Geneva.

Born in Göteborg, Sweden, in 1940, Mr. Eliasson was an exchange student in the United States 1957-1958. He graduated from the Swedish Naval Academy in 1962 and earned a Master’s degree in Economics and Business Administration in 1965.

(From the introduction) For more than a decade, international lawyers and international relations scholars have been fascinated by an ever-increasing number of international courts and tribunals. These are producing more international case-law, thereby replacing the traditional scarcity of international law precedents embodied in a few celebrated ICJ and PCIJ cases. Today, there is a host of frequently highly specialized international dispute settlement mechanisms like the WTO Dispute Settlement Body, the International Tribunal for the Law of The Sea, the International Criminal Court, various investment tribunals acting under The International Centre for Settlement of Investment Disputes (ICSID) Convention or other arbitration rules. All apply, interpret and probably ‘make’ international law. One question frequently raised in this context is whether these institutions contribute to the development of a single uniform body of international law or whether they make ‘their own’ ever more fragmented law. To the extent that they must apply specifically agreed upon rules, such as the WTO agreements, various bilateral investment protection treaties or the Law of the Sea Convention, etc., this is of course largely a false problem. In so far as they rely on common rules of international law, coherence vs. fragmentation does indeed arise and is a serious issue.

Scholars of international law have intensely debated these problems mostly under the heading ‘fragmentation’ of international law or ‘proliferation’ of international courts and tribunals. Gerhard Hafner has significantly contributed to this scholarly debate in a number of articles, and most importantly in a report prepared for the International Law Commission (ILC), which triggered the Commission’s work on fragmentation and was further pursued by Gerhard Hafner’s successor on the ILC, Martti Koskenniemi.

It thus appears appropriate to dedicate a few modest thoughts about these issues to a great international lawyer with whom I have had the privilege to work at the Department of International Law and International Relations at the University of Vienna during the last twenty years. Gerhard Hafner will understand that due to the space allotted in this liber amicorum, I must limit the scope of my remarks on fragmentation and proliferation to a specific subfield of international law. He will also appreciate that the chosen field is investment law and arbitration, which, in many respects, may be viewed as a test laboratorium of international law where many of the pertinent problems mentioned above have appeared in particularly visible form.

The Forum on Contemporary Europe (FCE) continues a multiyear study of the challenges facing European Union integration and global crisis intervention. The increasingly complex demands straining Europe and its trans-Atlantic relations—labor migration, spending on welfare economies, globalized cultures, and threats of terrorism, coupled with Europe’s struggle to ratify a single constitution—underline the need to measure prospects for unification and the EU’s ability to function as a coordinated international actor. This year, FCE is broadening its work to assess the role an integrated EU can play in addressing the world’s most troubling crises.

EU INTEGRATION: THE CASE OF TURKEY

The forum has explored the question of Turkey’s EU membership with Stanford scholars, European leaders, and the public. In spring 2006, former German foreign minister Joschka Fischer and author Christopher Hitchens offered candid analyses of EU expansion. Hitchens challenged commonplace descriptions of “Christian Old Europe” antagonized by “Islamicized” secular Turkey. Europe and Islam are not newly in contention, he said, but are playing out a centuries-old relationship grounded in the European and Ottoman empires in the Eastern Mediterranean. For Hitchens, the portrait of clashing civilizations obscures the crises facing minority Kurdish and neighboring societies whose survival is at stake in EU expansion.

Delivering the Payne lecture, Fischer noted the dilemma of seeking to achieve popular ratification of a European constitution at a time when public attention is galvanized by the Turkish candidacy. Fischer rejected common comparisons between European state rulings on Islamic traditions and models of U.S. multiculturalism. Fischer found admirable aspects of the U.S. inspiration but questioned its relevance for mediating myriad EU interests. For Fischer, the EU as a supra-state actor holds the promise to democratize conflict resolution in the deliberative model of the European Parliament and legitimate its role as a peacekeeping actor.

EU INTERVENTION: CRISIS MANAGMENT AND COMBATING INTERNATIONAL TERRORISM

The forum’s new focus on EU crisis intervention began with addresses by Sir Richard Dearlove, former head of Britain’s Security Services (MI-6), and Alain Bauer, former vice president of the University of Paris–Sorbonne and director of France’s National Institute for Higher Studies in Security, who discussed EU counterintelligence and international early-warning protocols. Greek Ambassador Alexandros Mallias spoke on the Eastern Mediterranean context that frames the Turkish candidacy, the economics of EU integration, and prospects for responding to the tensions in Cyprus. Austrian Ambassador Eva Novotny spoke on Austria’s immediate past EU presidency, evaluating the impact of the EU Council’s intervention in the Israel-Lebanon crisis. Professor Josef Joffe spoke on his new book, Uberpower: The Imperial Temptation of America, and the prospects for U.S.–EU interaction in global affairs.

The forum’s fall series brought public acclaim when Daniel Cohn-Bendit, co-president of the European Parliament Greens/New Alliance Parties, delivered FCE’s 2006–2007 “Europe Now” address, cosponsored by Stanford’s Abbasi Program in Islamic Studies and the Woods Institute for the Environment. Speaking to an overflow crowd, and meeting separately with faculty and researchers, Cohn-Bendit focused his public remarks on European Integration: Society, Politics, and Islam. A European Parliament leader, Cohn-Bendit spoke on his party’s proposal to deploy Joschka Fischer as the EU representative to Middle East peace negotiations. Expanding and integrating the EU, Cohn-Bendit argued, is the most reasonable strategy for strengthening Europe’s role in international relations and crisis intervention.

The Forum on Contemporary Europe continues to deepen scholarly and public understanding of the EU promise to achieve democratic governance, economic growth, security, and social integration among its member states and in its foreign engagements.

Mr. Biberaj and Mr. Kesic both examine the issue of Kosovan independence from different persepectives. Mr. Biberaj explains why he believes that supervised independence is the only way forward. Mr. Kesic, on the other hand, expresses concern at how this decision is being made.

Synopsis

Mr. Biberaj argues that if Kosovo is not to remain part of Serbia, then it has only two options. The first is a continuation of the status quo, which Mr. Biberaj feels is untenable. The second is supervised independence. Mr. Biberaj believes that this is a defining moment for the Balkans, and the region needs to move on from this issue. He argues that danger of renewed violence is exaggerated primarily because there is now a different situation and NATO peacekeeping forces are on the ground. Although a transition will not be easy, Mr. Biberaj feels that it will be manageable due to the widespread support this move has from the US and many European states. In addition, Mr. Biberaj argues that Russia and Serbia are powerless to do anything about the move.

What is crucial, however, is that Kosovo must rapidly look to the challenges ahead. Its government, which will be a coalition, must reach out to the Serb community, create a secure environment, and battle corruption and economic difficulties. Although Mr. Biberaj argues military confrontation must not be ruled out, to him, the general situation is relatively stable. Addressing religion, Mr. Biberaj explains that Serbian Islamists are self-assured and moderate and do not pose a serious threat in Serbia and Kosovo. Most importantly, Mr. Biberaj stresses that this is perhaps the last opportunity to peacefully solve this Albanian-Serb conflict without partitioning Serbia. He explains that the Serbs will eventually learn to live with Kosovo’s independence but also emphasizes the US must stay until “business is finished.”

Citing the withdrawal of troops in particular, Mr. Kesic argues, on the other hand , that Kosovo is an example of failed US diplomacy. It was taken for granted that Russia and Serbia would reluctantly accept the US and European states’ approach to the Kosovan problem, and the issue was dealt with too much as a vacuum, not taking into account neighboring players. Moreover, Mr. Kesic feels that the whole process has left Serbia no reason to trust the US and the European states involved. NATO has not fulfilled its promise of protecting minorities, the US is still not satisfied with Serbia even after it has gotten rid of Milosevic, and Kosovo is being treated as an exception to the territorial integrity principle employed for dividing up former Yugoslavia. Mr. Kesic argues that if the decision of Kosovan independence is made through continuing this same diplomatic process then instability will follow. Furthermore, supervised independence with protection by NATO is a selective interpretation of a UN resolution. Mr. Kesic believes such interpretations create chaos, make bypassing diplomacy the norm, and undermine UN peacekeeping efforts. In addition, what is the point of establishing democracy in Serbia if the international community treats it in the same humiliating way as it did Serbia’s previous regime? To Mr. Kesic, we must also continue to take seriously issues that could lead to war, such as tensions between Albanians and Serbs in Kosovo itself. Finally, Mr. Kesic concludes by arguing that the EU’s common foreign policy is really what is being “put on the line.”

ABOUT THE SPEAKERS

Elez Biberaj is a 27-year veteran of the Voice of America. As division director, he brings to bear considerable radio and television broadcasting experience and Eurasian market knowledge in planning, directing, and developing VOA's multimedia programming in Russian, Ukrainian, Albanian, Bosnian, Croatian, Greek, Macedonian, and Serbian. Dr. Biberaj joined VOA's Albanian Service as an international radio broadcaster in 1980. From 1982 to 1986, he worked in the Press Division of the former U.S. Information Agency as a senior writer/editor, specializing in Soviet and East European Affairs. Dr. Biberaj returned to VOA as Albanian Service Chief in 1986, and, for the next 18 years helped transform the service into one of VOA's most successful broadcasting units. For over a decade, he served in dual capacity as chief of the Albanian Service and director of European Division writers and researchers. In the latter capacity, he directed the work of division writers and researchers, developed broad strategies for providing program material and research, and assigned coverage of events and topics of importance to Eastern Europe, and edited program material for use by division services.

Dr. Biberaj was named the Eurasia Division's managing editor in 2004, became acting director the following year, and was appointed division director in December 2006. In his Eurasia Division managerial positions, Dr. Biberaj helped develop new programming strategies that enabled language services to take advantage of new technologies, improve existing programming formats, and better meet audience demands in a highly competitive media environment. His expertise and knowledge of Eurasian affairs and of U.S. foreign policy objectives have been recognized inside and outside of VOA. On many occasions, he has been invited by the State Department, the National Security Council, and other U.S. government agencies, academia, and non-governmental organizations to participate in policy planning exercises, conferences, and panel discussions. He has also appeared on television outlets such as CNN, ABC, Fox, NBC, and CBC to comment on Balkan affairs.

Dr. Biberaj has written widely on the horrors of communist rule in Albania, the long struggle of Albanians in former Yugoslavia for human and national rights, and the daunting challenges that Albania has faced in its transition from communism to democracy. Elez Biberaj has a Ph.D. in political science from Columbia University. He has authored three books on Albanian affairs and contributed chapters to several others. He has also published articles in Encyclopedia Britannica, Conflict Studies, Problems of Communism, Survey, The World Today, East European Quarterly, The Wall Street Journal/Europe, etc.

Obrad Kesic is a Senior Partner with TSM Global Consultants, LLC. Mr. Kesic is also currently working with the Balkan countries on behalf of the Congressional National Prayer Breakfast. Over the last decade, Mr. Kesic has been working with the governments and with nongovernmental organizations in South Eastern Europe. Mr. Kesic also serves as a consultant on Balkan affairs for various US and international organizations and agencies. Mr. Kesic has provided analysis and briefings for US government agencies and officials, including The Department of State, The Department of Defense and the United States Information Agency. Mr. Kesic also provides frequent commentary and analysis for the US and international media, including for National Public Radio, CNN International, BBC, Voice of America, USA Today, and Monitor Radio. Mr. Kesic has authored dozens of articles and essays on Balkan affairs and on US policy toward the Balkan states. He is a frequent speaker to community, professional and scholarly groups. Mr. Kesic is a member of the Board of Directors of the Institute on Religion and Public Policy. He is also a member of the Board of Directors of the private company, SuperDrive, Inc.

Selma Leydesdorff will speak on the results of her interviews with the women who survived the worst massacre in Europe since World War II. She will discuss these women as individuals and as a group, explain why they are today labelled 'difficult' and what such a label means, and will take a closer look at the memory of the trauma of the genocide and the years of the violent siege of Srebrenica.

 

Professor Leydesdorff received a MA (1972) and Ph.D. (1987) in modern history from the University of Amsterdam. She has served as a member of the Women’s Studies Research Council at the University of Amsterdam (1985-88), a member of the National Science Committee (1985-91), Chair of the National Oral History Association (1986-96), Secretary of the International Oral History Association (1990-96), Secretary of l’Association de Development de l’Approche Biographique (1990-97), and she currently chairs the Commission on the History of Culture of Jews of the Dutch Royal Academy. She is also the principle editor of Memory and Narrative (Transaction Publishers Inc, 2005). She has been a visiting scholar at European University in Florence and at Rutgers University in New Jersey, and has held visiting professorships at Dickinson College, Anton de Kom University in Suriname, Sabanci University in Istanbul, Xiamen University in China, and most recently at New York University. Professor Leydesdorff is currently a fellow at the Remarque Institute at NYU.

 

Event Synopsis:

Dr. Leydesdorff recounts the 1995 massacre at Srebrenica in which 7,749 Muslims were killed by Bosnian Serb troops as Dutch peacekeeping forces stood by. Leydesdorff asserts that official inquiries ignored voices of the survivors - many of them women who had lost sons and husbands. Today, the survivors continue their campaign to have their stories heard, to find out what happened and why, to uncover information on victims yet to be identified, and to improve their economic conditions. They also believe the Dutch should apologize for failing to prevent the genocide.

Dr. Leydesdorff describes her own research project in which she interviewed women survivors. She conveys the chaos and despair resulting not just from the genocide of men and boys but of the simultaneous rape of women and girls by the Serbian soldiers. She explains why so many survivors have remained silent, and discusses the complexity of relationships between neighbors who once lived in peaceful coexistence but who now live with memories of betrayal and grief. 

Finally, Leydesdorff described ongoing efforts of the group, including monthly marches on Sarajevo and a funeral for hundreds of newly identified victims that was attended by 60,000 people.

Peter Maurer is Switzerland's first Ambassador and Permanent Representative to the United Nations, assuming the position in September 2004, when Switzerland became the body's 190th member. He was a leader of the ultimately successful effort to establish the Human Rights Council in early 2006.

Maurer studied history, political science and international law at universities in Berne and Perugia, obtaining his Ph.D. from the University of Berne in 1983. After lecturing at the university's Institute for Contemporary History, he joined Switzerland diplomatic service in 1987. He was immediately posted to Switzerland's embassy in South Africa. There he witnessed the violent last throes of the Botha regime, and the first steps towards reforming and ultimately eliminating apartheid.

Maurer returned to Switzerland and became Secretary to the State Secretary for Foreign Affairs. In 1996 he was posted to New York where he served as Deputy Permanent Observer of the Swiss Mission to the UN. In May 2000 he assumed the rank of Ambassador and returned to Berne to become head of Political Affairs Division IV (Human Security). In that capacity, Maurer managed Switzerland's increasingly robust and innovative human rights diplomacy, launching, among other initiatives, the Berne process, a grouping of countries engaged in human rights dialogues with China.

Ambassador Maurer will talk about the UN Human Rights Council, of which Switzerland was in the forefront of creating. He will address questions related to Europe: how European human rights and security issues are being treated within the UN, and will attempt to answer the question of why the Swiss people have embraced the UN but have been reluctant to join the European Union.

Ambassador Maurer describes Switzerland's decision to join the United Nations and outlines the achievements it has made in the 5 years since gaining membership. These achievements encompass a broad human security agenda and include developing mine detection technology, combatting small arms dealing, improving natural disaster preparedness, and promoting accountability for crimes against humanity and for the actions of UN peacekeeping troops. Switzerland was a strong supporter of the International Criminal Court and has pushed for improvements to the UN's mediation processes. It has also shaped discussion about the reform of the UN Commission on Human Rights.

Ambassador Maurer then offers prospects for issues such as engagement with North Korea, trans-regional alliances on issues of human rights, and the future of the Human Rights Council. He also describes recent cooperation with China and Russia on the topic of human rights. Moving forward, Ambassador Maurer believes Switzerland's best option for making its voice heard on the international stage will be to expand existing partnerships with European universities and to mobilize applied scientific research to help solve the world's most pressing issues.

A discussion session following the talk raised such issues as: What is Switzerland's approach to the areas of the world, for example those under Sharia law, where international human rights are not a common value? How will the western and non-western parts of the world bridge their very different approaches to human rights? Can cultural influence be more effective than formal multilateral institutions like the UN on certain issues? Should existing organizations like the ICRC deal with refugees from environmental degradation (like rising sea levels)? Is there conflict between different international organizations who deal with the same agenda items, such as between the EU and UN?

David Holloway is the Raymond A. Spruance Professor of International History, a professor of political science, and an FSI senior fellow. He was co-director of CISAC from 1991 to 1997, and director of FSI from 1998 to 2003. His research focuses on the international history of nuclear weapons, on science and technology in the Soviet Union, and on the relationship between international history and international relations theory. His book Stalin and the Bomb: The Soviet Union and Atomic Energy, 1939-1956 (Yale University Press, 1994) was chosen by the New York Times Book Review as one of the 11 best books of 1994, and it won the Vucinich and Shulman prizes of the American Association for the Advancement of Slavic Studies. It has been translated into seven languages, most recently into Chinese. The Chinese translation is due to be published later in 2018. Holloway also wrote The Soviet Union and the Arms Race (1983) and co-authored The Reagan Strategic Defense Initiative: Technical, Political and Arms Control Assessment (1984). He has contributed to the Bulletin of the Atomic Scientists, Foreign Affairs, and other scholarly journals.

Since joining the Stanford faculty in 1986 -- first as a professor of political science and later (in 1996) as a professor of history as well -- Holloway has served as chair and co-chair of the International Relations Program (1989-1991), and as associate dean in the School of Humanities and Sciences (1997-1998). Before coming to Stanford, he taught at the University of Lancaster (1967-1970) and the University of Edinburgh (1970-1986). Born in Dublin, Ireland, he received his undergraduate degree in modern languages and literature, and his PhD in social and political sciences, both from Cambridge University.
